Terms of Use

1. Who we are

SummiQ is operated by:

In these Terms, “SummiQ”, “we”, “us” and “our” mean DynamIQ Fit B.V.

2. Who can use SummiQ

You must be at least 16 years old to create a SummiQ account.

Your account is personal to you.

Please:

• provide reasonably accurate account information;
• keep your login details secure;
• do not share your account with other people; and
• tell us if you believe someone else has gained unauthorised access to your account.

You are responsible for activity carried out through your account unless that activity results from something for which SummiQ is responsible.

3. The SummiQ service

SummiQ is an endurance training platform that helps athletes plan, analyse and review their training. Depending on the features available to you, SummiQ may provide:

• workout and activity analysis;
• training history;
• training plans;
• performance and training metrics;
• heart-rate, power and pace analysis;
• training-load and recovery insights;
• goal tracking;
• AI-assisted coaching;
• recommendations about future training; and
• integrations with sports devices and services.

Features may develop over time as we improve SummiQ.

4. The free plan and fair use

SummiQ currently offers a free plan.

We want the free plan to be genuinely useful. In return, we ask everyone to use it fairly.

What fair use means

The free plan is intended for the normal personal use of an individual athlete.

Normal use includes uploading and analysing your activities, reviewing your training, using coaching features and interacting with SummiQ in the way the product is designed to be used.

Fair use does not include, for example:

• operating automated bots or scripts against SummiQ unless we expressly provide that functionality;
• making unusually large numbers of automated AI or data-processing requests;
• repeatedly uploading or processing data primarily to consume excessive system resources;
• using SummiQ as general-purpose computing, storage or AI infrastructure;
• scraping or systematically extracting SummiQ content or data;
• sharing one personal account between multiple users;
• reselling or commercially redistributing access to SummiQ;
• attempting to bypass technical usage limits;
• deliberately stress-testing the service without our permission;
• interfering with the operation or security of SummiQ; or
• using SummiQ for unlawful purposes.

We may apply reasonable technical limits, rate limits or usage caps to protect the free service and keep it available to everyone.

Where possible, we will make relevant limits visible in the product. If your usage is unusually high, we may temporarily slow down or limit certain functionality.

Normally, we will contact you before suspending an account for fair-use reasons and give you a reasonable opportunity to change your use.

We may act immediately where this is reasonably necessary to protect SummiQ, other users, our infrastructure or security.

We will not terminate an account permanently for a minor one-off fair-use issue. Permanent suspension will generally be reserved for serious or repeated misuse.

5. Your training data and content

You can provide SummiQ with information such as activities, routes, workout files, training plans, goals, notes and other content.

You remain responsible for content that you upload.

You must have the right to provide that content to SummiQ.

You keep any intellectual-property rights you have in content you upload.

You give SummiQ the limited rights necessary to store, process, analyse, reproduce and otherwise use that content only as necessary to operate, secure and improve the SummiQ service in accordance with these Terms and our Privacy Policy.

Our handling of personal data, including health and fitness data, is governed by our Privacy Policy and applicable data-protection law.

6. Training recommendations are not medical advice

SummiQ is a training and performance tool.

It is not a medical service.

SummiQ does not diagnose medical conditions, provide medical treatment or determine whether it is medically safe for you to exercise.

Training inherently involves risks. Your fitness, health, environment, equipment and circumstances can change, and SummiQ cannot observe everything that may affect whether a workout is suitable for you.

You remain responsible for deciding whether to start, continue, modify or stop a training session.

Do not ignore symptoms, injuries or medical advice because of a SummiQ recommendation. If you are unsure whether training is medically appropriate for you, consult an appropriately qualified healthcare professional.

7. AI coaching

SummiQ uses artificial intelligence to help analyse training and generate recommendations.

AI can be useful, but it is not perfect.

AI-generated information may sometimes be incomplete, inaccurate or unsuitable for your individual circumstances.

SummiQ therefore presents AI coaching as recommendations, not as instructions that you are required to follow.

You should use your own judgement when acting on AI-generated advice.

SummiQ does not use AI to make decisions that have legal or similarly significant effects concerning you.

8. Third-party services and devices

SummiQ may allow you to import information from, export information to, or connect with third-party devices and services.

These may include sports watches, bike computers, activity platforms and other training services.

Those services are operated by third parties and may have their own terms and privacy policies.

We cannot guarantee that a third-party service will always remain available or compatible with SummiQ.

If a third party changes or discontinues its service, API, file format or functionality, this may affect the corresponding SummiQ integration.

This does not affect any rights you have against SummiQ under mandatory consumer law.

9. Keeping SummiQ available

We aim to keep SummiQ reliable and available.

However, software occasionally needs maintenance and internet services sometimes experience interruptions. We do not promise that SummiQ will be available without interruption or that every calculation, metric, import or recommendation will always be error-free.

We may temporarily restrict access where reasonably necessary for:

• maintenance;
• upgrades;
• security;
• incident response;
• technical problems; or
• legal or regulatory reasons.

We will try to minimise disruption where reasonably possible.

Your statutory rights relating to digital services are not affected by this section.

10. Changes to SummiQ

We expect SummiQ to evolve.

We may add, remove or change features where there is a reasonable reason to do so, for example to:

• improve the service;
• introduce new functionality;
• improve security;
• respond to technical changes;
• discontinue little-used functionality;
• comply with law; or
• maintain the sustainability of the service.

We will not deliberately make material changes simply to deprive consumers of what they reasonably agreed to receive.

If we make a change that materially and negatively affects your ongoing use of SummiQ, we will give reasonable notice where appropriate.

You are always free to stop using the free service and delete your account.

11. Future paid plans

SummiQ is currently launching with a free tier.

We may introduce SummiQ Premium or other paid plans in the future.

We will not automatically convert your free account into a paid subscription. Before you purchase a paid service, we will clearly tell you:

• what is included;
• the price;
• the billing period;
• how renewal works;
• how you can cancel; and
• any additional terms that apply.

You will need to actively agree to the applicable price and subscription conditions before being charged.

The introduction of a paid plan does not create an obligation for you to purchase it.

Some features that are introduced in the future may be available only on paid plans.

12. Advertising

The free version of SummiQ may in the future be supported partly by advertising.

Where advertising is introduced, the way personal data and cookies may be used for advertising will be explained in our Privacy Policy and Cookie Policy.

Where consent is legally required for personalised advertising or tracking, it will be requested separately.

Refusing optional advertising tracking will not prevent you from accessing the core free SummiQ service, although you may still see non-personalised advertising.

We do not use health, physiological or detailed training data to target advertising.

13. SummiQ intellectual property

The SummiQ software, design, branding, graphics, databases, algorithms and other materials created by or for SummiQ are protected by intellectual-property rights.

Except where expressly permitted, you may not:

• copy or redistribute substantial parts of SummiQ;
• reverse engineer SummiQ except where applicable law expressly permits this;
• remove intellectual-property notices;
• present SummiQ as your own service; or
• use SummiQ's branding without permission.

These restrictions do not prevent you from using, downloading or exporting your own information where SummiQ provides that functionality or applicable law gives you that right.

14. Suspension and termination

You can stop using SummiQ at any time.

You can request deletion of your account through the functionality provided by SummiQ or by contacting support@summiq.eu.

We may temporarily suspend or restrict an account where reasonably necessary because:

• these Terms have been materially breached;
• fair-use limits have repeatedly or seriously been exceeded;
• there is suspected fraud or abuse;
• account security has been compromised;
• use of the account creates a material security or operational risk;
• use of SummiQ is unlawful; or
• we are legally required to do so.

Where reasonably possible, we will explain the reason and give you an opportunity to resolve the issue before permanently terminating your account.

We may discontinue the free SummiQ service in the future. If we do so, we will provide reasonable advance notice unless immediate action is required for legal, security or circumstances outside our reasonable control.

Account deletion and personal-data retention are dealt with in our Privacy Policy.

15. Our responsibility

SummiQ is responsible for providing the service in accordance with these Terms and the mandatory rights you have under applicable consumer law.

Nothing in these Terms excludes or limits liability where doing so would not be permitted by law.

When assessing training information or recommendations, remember that SummiQ depends partly on information supplied by you, your devices and third-party services. Incorrect or incomplete input data can produce incorrect or incomplete results.

To the extent permitted by applicable law, SummiQ is not responsible for loss caused by:

• your decision to disregard clear warnings or instructions;
• inaccurate information supplied by you;
• failure of equipment or third-party services outside our reasonable control; or
• misuse of SummiQ contrary to these Terms.

Nothing in this section removes any mandatory rights available to you as a consumer.

16. Privacy

Your privacy is important to us.

Our Privacy Policy explains how we process personal data, including training information and health- related data.

Our Cookie Policy explains how we use cookies, analytics and similar technologies.

Those documents form part of the information governing your use of SummiQ, but accepting these Terms does not automatically constitute consent to processing for which applicable law requires separate consent.

17. Changes to these Terms

We may update these Terms where reasonably necessary because SummiQ, our business or applicable law changes.

If a change materially affects your rights or obligations, we will notify you in an appropriate way before it takes effect.

Where a material change is disadvantageous to you, you may stop using SummiQ and terminate your account.

We will not treat your continued use of SummiQ as consent where the law requires a separate affirmative agreement.

18. Problems and complaints

If something is not working as expected, please contact us first.

We would like the opportunity to resolve it.

Nothing in these Terms restricts your right to use any statutory consumer complaint or dispute-resolution mechanism available to you.

19. Dutch law

These Terms and your agreement with SummiQ are governed by Dutch law. If you are a consumer living elsewhere in the European Union or EEA, this choice of Dutch law does not deprive you of mandatory consumer protections that apply to you under the law of your country of residence.

Any dispute may be submitted to the court that has jurisdiction under applicable law.

20. Final provisions

If part of these Terms is invalid or unenforceable, the remaining provisions continue to apply.

An invalid provision will not be interpreted more broadly than permitted by applicable law.

If we do not immediately enforce a provision of these Terms, that does not mean we permanently give up the right to enforce it.

These Terms apply from 8 September 2026.
